1. Introduction

Welcome to M-SAG ("Company," "we," "our," "us"). By accessing our website or purchasing our web development services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you are prohibited from using our services.

M-SAG is a digital agency providing:

  • Custom Website Design & Development.

  • Branding & Visual Identity.

3. Payments and Refunds

  • Pricing: Services are billed based on the custom quote provided to you. We reserve the right to change pricing for future projects at any time.

  • Payment Terms: A non-refundable deposit (typically 50%) is required to secure your booking, with the remaining balance due upon project completion or as per the agreed milestone schedule. Payments are processed securely via trusted third-party gateways.

  • Refund Policy: Due to the custom, digital nature of our work, all sales are final. We do not offer refunds once the design process has commenced. However, we are committed to satisfaction through our revision policy.

 

4. Intellectual Property Rights

  • Our IP: M-SAG retains all rights to the underlying tools, frameworks, and pre-existing code used to build your site.

  • Client Ownership: Upon full payment, you (the Client) will own the final design, visual assets, and content of the website.

  • Portfolio Rights: You grant M-SAG a non-exclusive right to display your project (screenshots, links, or video walkthroughs) in our portfolio, social media, and marketing materials for promotional purposes.

 

5. Client Obligations

To ensure the timely delivery of your project ("Build With Us" workflow), you agree to:

  • Provide all necessary text, images, and credentials within a reasonable timeframe.

  • Participate in feedback loops promptly.

  • Delays caused by the client's failure to provide assets may result in extended project timelines.

 

6. Revision Policy

Revisions are included as specified in your project proposal or invoice. Standard projects typically include 2 rounds of revisions. Any additional revisions or major scope changes after approval may incur additional fees at our standard hourly rate.

 

7. Limitation of Liability

To the fullest extent permitted by law, M-SAG shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. We are not responsible for any downtime, data loss, or security breaches caused by third-party hosting providers or cloud platforms.

 

8. Third-Party Platforms

Our services rely on third-party hosting and content management platforms. By using our services, you acknowledge that your website may also be subject to the Terms of Service and Privacy Policies of these underlying platform providers.

 

9. Governing Law

These Terms shall be governed by and defined following the laws of India. M-SAG and yourself irrevocably consent that the courts of Karnataka shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
